Updates to This Agreement

We reserve the right to modify or add to this Agreement at any time without prior notice (“Updated Terms”). You agree that we may notify you of the Updated Terms by posting them on the Cards2Life Platforms so that they are accessible via a link on the home page, and that your use of the Cards2Life Platforms after we have posted the Updated Terms (or engaging in such other conduct as we may reasonably specify) constitutes your agreement to the Updated Terms. Therefore, you should review this Agreement before using the Cards2Life Platforms. The Updated Terms will be effective as of the time of posting, or such later date as may be specified in the Updated Terms, and will apply to your use of the Cards2Life Platforms from that point forward.

Cards2Life (“Cards2Life”, “we”, “us” or “our”) spends a lot of time thinking about what is important to you. We know that includes making the most of birthdays and holidays, spectacular paper sculptures, bloom-filled trees, and sharing unexpected Magical Moments with the people you love.

We also know your privacy is very important to you. It is to us, too. This Privacy Policy explains how and why we use, share and protect information that could be used to identify you (“Personal Information”) and the choices you have about Personal Information. We collect a variety of information about our Users, in different ways.
Information You Provide To Us

We collect Personal Information that you provide to us by, for example, filling out a form, registering for an account, making a purchase, or contacting us. We collect Personal Information you provide to us in several ways, including:

PAYMENT INFORMATION

Cards2Life uses third party payment processors Shopify, Stripe, Amazon Pay and PayPal to process payments made for products and services via the Website. All online payments will be conducted in accordance with Payment Card Industry (PCI) data security standards. Your billing information (which is only used by these payment processors for fraud protection) is encrypted before being communicated to them. Subject to the below exceptions, your credit card details are communicated directly from your browser to these payment processors - Cards2Life never sees your full Permanent Account Number (PAN).

Shopify

Shopify, Inc. provides us with the online e-commerce platform that allows us to sell our products and services to you. Some of your Personal Information is stored through Shopify’s data storage, databases and the general Shopify application. Shopify stores your data on a secure server behind a firewall.

If you use a credit card to make a purchase (with the exception of wedding and membership purchases, which are discussed below), then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

In addition, it is possible that in the future another company may acquire Cards2Life or its assets or that Cards2Life may partner with or purchase another company to continue to do business as a combined entity. In the event that any such transaction occurs, it is possible that Personal Information, may be transferred to the new business entity as one of Cards2Life’s assets. In such an event, we will update this policy to reflect any change in ownership or control of your Personal Information.

WHERE WE STORE DATA

Cards2Life transfers, processes and stores data about you on servers located in the United States. We use data processors, however, that may store or process your data in a different country. Your Personal Information may therefore be transferred to, processed and stored in a country different from your country of residence, and be subject to privacy laws that are different from those in your country of residence. Information collected within the European Economic Area (“EEA”) and Switzerland may, for example, be transferred to and processed by third parties located in a country outside of the EEA and Switzerland, where you may have fewer rights in relation to your Personal Information. Communications from Cards2Life
If you do not want to receive email communications from Cards2Life about our own or third-party products and services that may be of interest to you, you can update your preferences in the My Account section of our Website. You can also click on the unsubscribe link at the bottom of one of our emails. We may still contact you via mail or phone, unless you request to be added to our Do-Not-Call list, and/or our Do-Not-Mail list by contacting us using the below details and indicating your preferences. Please be sure to provide your exact name, e-mail address, mailing address and telephone number(s) and the list or lists you would like to be included on (Do-Not-Call, and/or Do-Not-Mail).

Deactivation Of Your Account

You may request deactivation of your Cards2Life account by contacting us using the contact information below and requesting deactivation. Please note that you Personal Information may remain in our archived records after your account has been deactivated, but we will not keep it for longer than necessary to fulfill the purposes described above.

Retention and Deletion

We retain Personal Information for as long as useful or permitted to further the purposes of collection. You can request deletion of your Personal Information. We provide information on how to do that below. Remember, though, that even if you request deletion of your information, we may keep certain information for a time after your deletion request to comply with legal or recordkeeping requirements. Also, we may not always be able to delete all of your information because of technical or other constraints.

If you use one of our Apps on the Apple Platform, you acknowledge and agree that Apple, and Apple’s subsidiaries, are third party beneficiaries of this Agreement, and that, upon your entry into this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third party beneficiary.

No Waiver

The waiver by either party of any breach of this Agreement will not be construed to be a waiver of any succeeding breach or any other covenant. All waivers must be in writing, and signed by the party waiving its rights. This Agreement may be modified only by a written instrument executed by authorized representatives of you and Cards2Life.

Entire Agreement

This Agreement, along with any applicable written Additional Terms, constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes all prior agreements, proposals, negotiations, representations or communications relating to the subject matter. Both parties acknowledge that they have not been induced to enter into this Agreement or Additional Terms by any representations or promises not specifically stated herein or in the written Additional Terms.

Cards2Life Terms of Service Agreement (“Agreement”) between Cards2LifeCM, Inc., on behalf of itself and its affiliates, with offices at 852 E 1910 S #3, Provo, Utah 84606 (“Cards2Life,” “we,” “us,” or “our”) and “you,” the user. This Agreement applies to the Cards2Life’ websites and related mobile applications (any, an “App”) that post this Agreement, and any available interactive features, downloads, applications/apps, widgets or other outlets that post or include a link to this Agreement (collectively, the “Cards2Life Platforms”). This Agreement applies to your use of the digital content available through Cards2Life Platforms, regardless of whether accessed via computer, mobile device or otherwise. To use the digital content available through the Cards2Life Platforms, you will need a device that meets the system and compatibility requirements for the relevant products and services, which may change from time to time, and such system requirements are your responsibility. By accessing, browsing, and/or using the Cards2Life Platforms (including purchasing any products and services), you acknowledge that you have read, understand, and agree to be bound by the terms of this Agreement, as well as our Privacy Policy and further agree to comply with all applicable laws and regulations. There may be times when we offer a service or feature that has its own written terms and conditions that apply in addition to this Agreement (“Additional Terms”). In those cases, the Additional Terms will control to the extent there is a conflict with this Agreement, unless the Additional Terms state otherwise. If you access one of our Apps on or through a third party platform, such as Apple’s App Store, Google Play and other third party platforms (any, an “App Platform”), you and Cards2Life acknowledge that (a) you enter into this Agreement with Cards2Life only, and not with the App Platform, (b) the App Platform is not a party to this Agreement, and (c) Cards2Life, not the App Platform, is responsible for the App.

THE TERMS OF THIS AGREEMENT CONTAIN WARRANTY DISCLAIMERS AND OTHER PROVISIONS THAT LIMIT OUR POTENTIAL LIABILITY TO YOU. PLEASE READ THIS AGREEMENT IN ITS ENTIRETY. If you do not agree to the terms of this Agreement, please do not use any of the Cards2Life Platforms.
